Terms of Service

§1 General provisions
These terms of service (the „Terms”) set out the rules for using the Hunter service available at https://hunter.workplays.it(the „Service”). The Service supports employers and recruiters in the game development industry (gamedev) in sourcing and selecting candidates, and enables gamedev professionals to voluntarily join the talent base and use a free professional-profile analysis.
The Service is provided by WORKPLAYS IT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄwith its registered office in Lublin, Poland, ul. Związkowa 26, 20-148 Lublin, KRS: 0001097357, NIP (tax ID): 7123473171, REGON: 528250745 (the „Provider”). Contact: office@workplays.it or in writing to the registered office address.
The Service is currently offered as a private beta: features may change and availability of the Service is not guaranteed. Reading and accepting these Terms is a condition of using the Service.
§2 Definitions
- User - an entrepreneur (employer, studio, recruiter) using the Service in connection with its business, for whom the Provider has created an Account;
- Account- the User's individual space in the Service protected by login credentials; an Account may be a trial account (limited in time);
- Candidate- a gamedev professional whose professional profile is processed in the Service or who uses the Service's candidate-facing features;
- Candidate Base - a non-public directory of professional profiles maintained by the Provider;
- Consent Form - the form through which a Candidate confirms interest in a specific role and consents to further contact and to their profile being presented to the employer;
- Profile Scan - a free service for Candidates: an AI-assisted analysis of a public professional profile together with market context;
- Business day - Monday to Friday, 9:00-17:00, excluding Polish public holidays;
- Force Majeure - an external, extraordinary event that could not have been foreseen or prevented with the utmost diligence.
§3 Scope of the service for Users
Within the Service, the Provider enables the User in particular to:
- define and manage recruitment roles (subject to a limit of open roles per Account);
- source and match Candidate profiles to defined roles from multiple channels, with the assistance of AI tools;
- contact Candidates on a consent basis (§6) and handle responses;
- publish job ads in affiliated WorkPlays services;
- access reports and statistics on running processes.
The detailed feature set may vary depending on the stage of the Service's development and arrangements between the Provider and the User. Match results and scores generated in the Service are auxiliary in nature - they do not guarantee recruitment outcomes, and final decisions rest with the User.
§4 Accounts and trial accounts
Accounts are created by the Provider for invited Users. The User must keep login credentials confidential and is responsible for all activity performed with their Account. Any suspected unauthorised access must be reported to the Provider without delay.
A trial account is limited in time (7, 14 or 30 days); after the trial period access is blocked automatically. The Provider may convert a trial account into a full account at any time. Data stored on a blocked trial account is retained in accordance with the Privacy Policy.
§5 Integration with the User's LinkedIn account
The Service allows the User to voluntarily connect their ownLinkedIn account (via an external integration-technology provider) so that invitations and messages are sent from the User's account. The User acknowledges that:
- one LinkedIn account may be connected to exactly one Account in the Service;
- automated activity may be restricted by LinkedIn's terms - the User connects the account and enables automation at their own risk;
- the Service applies protective measures (human-like sending pace, daily and weekly limits, automatic pausing upon warnings) but does not guarantee that the external service will not restrict the User's account;
- the User may disconnect their account at any time on the Integrations page.
§6 Contact with Candidates and consents
First contact with a Candidate is targeted and limited in volume, and includes information about data processing together with a simple way to decline. A Candidate enters the User's active recruitment process only after confirming interest through the Consent Form.
A Candidate's refusal or withdrawal of consent is binding - the User must not circumvent it or renew contact against the Candidate's decision.
§7 Candidate data - User obligations
Candidate data made available in the Service may be used by the User solely for the User's own recruitment processesand in accordance with data-protection law. In particular, it is prohibited to copy, export or further disclose Candidate data outside the User's own recruitment process, or to use it for marketing purposes unrelated to recruitment.
Upon disclosure to the User of the data of a Candidate who has given consent, the User becomes an independent controller of that data within its own recruitment process and is solely responsible for the lawfulness of its further processing.
§8 Services for Candidates
On the „For candidates” page a Candidate may request a free Profile Scan by providing a link to their public professional profile and an e-mail address, and consenting to contact about matching roles. Performing the scan requires e-mail confirmation (a verification link valid for 24 hours); the analysis is performed once and its result remains available under the received link.
- Profile Scan results are informational and do not guarantee recruitment outcomes;
- signing up adds the Candidate's profile to the Candidate Base; contact takes place only for roles genuinely matching the profile;
- the Candidate may withdraw consent and request erasure at any time - a reply to a received message or contact with the Provider (office@workplays.it) is sufficient.
§9 AI features
The Service uses AI models, among other things, to analyse role descriptions, structure professional profiles, assess match quality and generate guidance. AI output is supportive in nature; decisions about contacting Candidates and the course of recruitment are made by humans. The Provider strives for reliable results but does not guarantee they are error-free.
§10 Acceptable use
In particular, it is prohibited to:
- use the Service to send spam, misleading or unlawful content;
- contact Candidates for purposes other than recruitment;
- attempt to access other Users' data or disrupt the Service;
- automatically download, copy or re-create the Service's content (including the Candidate Base) in whole or in a substantial part;
- resell or sublicense the Service without the Provider's written consent.
§11 Intellectual property
The Service, including its software, design, know-how and content (excluding User data and Candidate data), remains the property of the Provider. The Candidate Base is a database protected by law. The Provider grants the User a non-exclusive, non-transferable licence to use the Service for the User's own recruitment purposes for the duration of their access.
§12 Liability
During the beta the Service is provided „as is”. To the maximum extent permitted by law, the Provider is not liable for indirect damages, lost profits, loss of data, or restrictions imposed on the User's accounts in external services (including LinkedIn) in connection with the use of the Service. The Provider is not liable for non-performance caused by Force Majeure. Nothing in these Terms excludes liability that cannot be excluded under mandatory provisions of law.
§13 Complaints
Complaints about the Service can be submitted to office@workplays.it. A complaint should describe the issue and identify the reporting party. The Provider handles complaints within 14 Business days of receipt.
§14 Term and termination
The User may stop using the Service at any time and request Account deletion. The Provider may suspend or terminate access that violates these Terms or harms the Service, its Users or Candidates. After access ends, Account data is deleted or anonymised within a reasonable period, subject to data whose retention is required by law or the Privacy Policy.
§15 Changes and governing law
The Provider may amend these Terms; material changes will be announced in the Service with reasonable notice. Continued use after changes take effect constitutes acceptance. These Terms are governed by Polish law; disputes are resolved by the court competent for the Provider's registered office. Matters not regulated herein are governed by Polish law, including the Civil Code and the GDPR. The processing of personal data is described in the Privacy Policy.
